1. Introduction

 

Welcome to Tobian Language School. These Terms and Conditions (“Terms”) govern the provision of all our language courses and services. By booking a course with Tobian Language School, you agree to be bound by these Terms. Please read them carefully.

This document forms a legally binding agreement between you (the “Student”) and Tobian Language School (“the School”, “we”, “us”, “our”).

 

2. Definitions

 

  • Agreement: The contract formed between the Student and the School upon confirmation of a booking.
  • Course Package: A set number of Lessons (e.g., 10, 20, or 40) purchased by the Student.
  • Lesson: A single teaching session, typically 60 minutes in duration, delivered either online or in-person.
  • Student: The individual purchasing and/or participating in a Course Package.
  • Teacher: The language tutor assigned by the School to deliver the Lessons.
  • Course Materials: Any digital or physical materials provided by the School for use during the course.

4. Our Services

 

4.1. Language Courses

 

The School offers live language tuition based on the Common European Framework of Reference for Languages (CEFR). Courses are available for all proficiency levels, from A1 (Beginner) to C2 (Mastery).

 

4.2. Delivery Method

 

Lessons are delivered either:

  • Online: via a video conferencing platform such as Zoom.
  • In-person: at a mutually agreed location.

 

4.3. Course Formats

 

Private Lessons: One-to-one tuition with a Teacher.

Group Lessons: A small group of up to three Students with one Teacher.

 

4.4. Course Packages

 

Our language courses are sold in packages of 10, 20, or 40 Lessons.

The price for each package is as stated on our website at the time of booking.

Prices are in Euros (€) and are inclusive of any applicable VAT unless expressly stated otherwise.

 

4.5. Website Language Tests

 

The language proficiency tests available on our website are provided for self-assessment and guidance purposes only. These tests are not official examinations and are not a substitute for a formal proficiency assessment.

 

The School offers no guarantee as to their accuracy, and we accept no liability for any decisions made based on their results.

 

The result is an informal estimate to help you choose a suitable course level.

 

4.6. Course Certificates and Recognition


Upon successful completion of a Course Package, the School issues a certificate confirming completion of participation in the course. The certificate reflects the level of study in line with the CEFR (Common European Framework of Reference for Languages) guidelines.

 

 

5. Booking and Payment

 

5.1. Formation of Agreement

 

An Agreement is formed when you complete the booking process and we send you a confirmation email containing your invoice.

 

5.2. Payment

 

Full payment for the chosen Course Package is required within 7 days of receiving the invoice and, in all cases, before the first Lesson commences.

 

Payment instructions will be provided on the invoice. Any bank transfer fees or transaction costs are the responsibility of the Student.

 

6. Course Package Validity and Scheduling

 

6.1. Validity Period

 

All Course Packages are valid for 365 days from the date of purchase. The Student must schedule and take their first Lesson within this period.

 

6.2. Expiry

 

Once the first Lesson has been taken, we encourage the completion of the package within the following guideline timeframes to ensure educational momentum:

 

  • 10-lesson packages within 4 months;
  • 20-lesson packages within 8 months;
  • and 40-lesson packages within 12 months.

 

The absolute expiry date for all unused lessons remains 18 months from the original date of purchase.

 

6.3. Scheduling Lessons

 

The scheduling of all subsequent Lessons is arranged directly between the Student and their assigned Teacher.

 

Availability is subject to the Teacher’s schedule.

 

7. Cancellation, Rescheduling, and Refund Policy

 

7.1. Cancellation of a Course Package by the Student

 

All Course Package sales are final. Course Packages are non-refundable. Once a package is purchased, the Student is committed to the full number of lessons.

 

This does not affect your statutory rights under Dutch law, including any applicable cooling-off period for distance contracts, provided no services have been rendered.

 

Any refund or credit offered outside of these terms is made entirely at the School’s sole discretion as a gesture of goodwill and does not constitute a waiver of this policy or set a precedent for future cases.

 

7.2. Rescheduling a Lesson by the Student

 

More than 24 hours’ notice: A Student may reschedule a Lesson at no charge by providing their Teacher with a minimum of 24 hours’ notice.

 

Less than 24 hours’ notice: If a Student cancels or reschedules a Lesson with less than 24 hours’ notice, the Lesson will be forfeited and deducted from their Course Package.

 

7.3. Student No-Show

 

If a Student fails to attend a scheduled Lesson within 15 minutes of the start time, they will be considered a “no-show”. The Lesson will be forfeited and deducted from their Course Package.

 

7.4. Cancellation by the School

 

The School reserves the right to cancel a Course Package at any time. In such an event, the Student will receive a pro-rata refund for all unused Lessons.

 

If a Teacher must cancel a single Lesson due to illness or emergency, the Lesson will be rescheduled at a mutually convenient time, or the package validity will be extended.

 

8. Teachers

 

8.1. Teacher Allocation

 

The School will assign a suitable Teacher based on the Student’s learning requirements and schedule.

 

8.2. Change of Teacher

 

Whilst we aim for continuity, the School reserves the right to change a Student’s Teacher if necessary.

If a Student is not satisfied with their assigned Teacher, they may request a change by contacting us at info@tobian-languageschool.com.

 

We take care in our initial assignment to match you with a suitable Teacher, and therefore requests for a change are limited to one (1) per Course Package and are granted at the School’s discretion.

 

We will make reasonable efforts to find a suitable alternative.

 

8.3. Long-Term Teacher Unavailability

 

In the event a Student’s assigned Teacher becomes unavailable on a long-term basis (due to illness, resignation, or other unforeseen circumstances), the School’s sole obligation will be to assign a suitable replacement Teacher to continue the Course Package.

 

No refunds will be issued for Course Packages where a suitable replacement Teacher has been offered in accordance with these Terms.

 

9. Student Obligations

 

9.1. Technical Requirements (for Online Lessons)

 

The Student is responsible for having a functioning computer, a reliable internet connection, a webcam, and a microphone.

 

The School is not responsible for Lessons that cannot be completed due to the Student’s technical failures.

 

9.2. Code of Conduct

 

The Student agrees to behave in a polite, respectful, and considerate manner at all times.

 

The School has a zero-tolerance policy for any form of discrimination, harassment, hate speech, or abuse directed at Teachers or other students.

 

A breach of this code of conduct may result in the immediate termination of the Agreement without a refund.

 

9.3. Age

 

Students must be at least 18 years of age to enter into this Agreement. Students under 18 must have the consent of a parent or legal guardian.

 

10. Intellectual Property

 

All Course Materials, including but not limited to lesson plans, documents, and exercises, as well as the School’s name, logo, and website content, are the exclusive intellectual property of Tobian Language School. These materials are for the Student’s personal educational use only.

 

Unauthorised reproduction, distribution, or sharing of any Course Materials is strictly prohibited and may result in legal action.

 

11. Liability

 

The School’s liability in connection with any claim arising from this Agreement shall be limited to the total fees paid by the Student for the relevant Course Package.

 

We are not liable for any indirect or consequential loss. Whilst we take care to ensure the accuracy of our Course Materials, we cannot be held liable for any errors or omissions.

 

12. Data Protection and Privacy

 

We are committed to protecting your privacy. We process your personal data in accordance with the General Data Protection Regulation (GDPR).

Please note that online lessons may be recorded for quality assurance and training purposes. Your participation in a lesson constitutes consent to being recorded.

 

13. Complaints and Dispute Resolution

 

13.1. Complaints

 

Should you be unsatisfied with any aspect of our service, please submit your complaint in writing to info@tobian-languageschool.com as soon as possible.

 

We will not consider complaints relating to a specific Lesson if submitted more than 7 days after the Lesson took place.

 

13.2. Governing Law and Jurisdiction

 

This Agreement, and any dispute or claim arising out of it, shall be governed by and construed in accordance with Dutch law. The parties irrevocably agree that the courts of Groningen, The Netherlands, shall have exclusive jurisdiction to settle any dispute or claim.

 

14. Force Majeure

 

Neither party shall be liable for any failure or delay in performing its obligations under the Agreement if such failure or delay is caused by a Force Majeure Event, such as natural disaster, war, or failure of public utilities. In such a case, the affected Lesson will be rescheduled.

 

15. General

 

15.1. Severability

 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

15.2. Amendments

 

The School reserves the right to amend these Terms at any time. The version applicable to your Agreement is the one that was in effect at the time of your booking.
